Medical negligence is sometimes referred to as medical malpractice. The two terms mean the same thing and refer to any kind of wrongdoing by a medical professional, usually a lack of undue care and attention toward the patient, causing harm and in some cases irreversible consequences. The term is very broad, and can refer to any case where this has occurred: for example, you may have had some surgery which left you with more scarring than necessary due to a lack of care taken by one of the professionals, you may have been incorrectly diagnosed as having a serious illness such as cancer when in fact you did not, or your broken limb may have been missed on x-ray and therefore not dealt with promptly, causing complications. All these things are examples of medical malpractice, and all could potentially cause undue suffering and harm to the victim which just wasn’t necessary and could have been avoided.
Whilst these cases are rare in the UK, they do happen. With any contract entered into between medical practitioner and patient, it is taken as assumed that the medical practitioner is in a position of responsibility to the patient and therefore has a duty of care towards them to ensure that they do everything they can to avoid mistakes occurring. Because of the difficult nature of medical work, a case needs to be proved that any reasonable doctor or medical practitioner would not have acted in the way that the individual did for their behaviour to be considered to be malpractice. Some cases are straightforward to prove, but others can be harder.
